Someone posted on an earlier thread that to get federal disability you need to be out of work for one year. I was told no, but apparently that was incorrect.
The man that is working on my case told me that very thing today. I went out Dec 2011, and since I'm in recovery from surgery he'll have to deny my claim, even though I'm not ready or have been cleared to go back to work. Today has been a very difficult day recovery wise and to get this phone call was NOT what I needed to feel any better. Did the guy miss his quota for denied claims and felt the need to deny mine on the phone as his last work day of the week? Why was that necessary? As if we don't have enough on our plates as it is...
I've had no income since my short term disability ended mid June. This denial will ensure I'll lose my house. I'm single, and the loss of income is devastating. I asked this guy how recovery can continue when you have effectively told me I'm going to lose my house? He said he can't take that into consideration. I hope the fact that I was crying as we hung up made his day complete, he made his goal...
Oh my god that is so maddening. I'm sorry to hear that, Emmaline. There are no words to take that pain away... I am waiting to find out whether I can get short term disability through my work right now. It's been a month and will take them another couple of weeks to do their research... Our savings are nearly exhausted already. :( I am keeping you in my thoughts. Hopefully something amazing will happen for you.
I am a bit confused..have you applied for SSDI? If so, did you get a written denial?? If you did get a written denial you can appeal it.
My understanding is that you have to be unable to work fulltime for at least one yr. Unfortunately, once on SSDI you don't get Medicare, I believe, for 2 yrs.
Have you spoken to a diability attorney yet??/
I know what you mean when you say it is a lonely time....Chiari can be a very isloating condition..in my own experience , it has been at times...and it is hard when you feel so alone.
Please know that we are all here for one another...through good and bad times.
This is the place to come and get connected with others..this group is the only one I belong to..and let me tell you, the folks here have picked me up when I was down and out....more times than I can count.
Like Razzle said try using ALL SUP, they do not take as much as the others do. I am using them now with my appeal hearing on the 9th of Aug. Been fighting since Dec 2010 for SSD yes there is a waiting period but I was told by All Sup that if it goes to appeal one of the things the ask for is that the waiting period be included during the wait for appeal and the appeal decision. I didn't see it but did / does your employer offer Long Term Disability, usually they offer both and have you tried that. Sorry it is a stupid question , but it may have been overlooked with all the other stressors that you have right now.
I am sorry to hear too that you are in such a rough situation. You will be in my thoughts and prayers and I wish I was able to do more but if you need to vent , cry, whatever, get a hold of me. I will listen and help to the best of my abilities.
You don't have to be out of work for a year to get Social Security Disability. Do you have a contact at your local office? Mine started the day after my last day at work. I would definitely call and speak with someone else, If you don't feel like going to the closest office. I am so sorry. I know you are devastated.
